High Court Refuses Injunction — Orders KNUST to Post GH¢1,000,000 Undertaking as Construction Continues

The High Court of Justice, Kumasi refused an interlocutory injunction to halt KNUST's construction on the Benimasi-Boadi ancestral heritage site on 24 July 2025. The Court ordered KNUST to execute an Undertaking of GH¢1,000,000 payable to the Plaintiff should the action succeed, and directed expedited trial. Land Rights Defenders Inc. confirms that construction on the sacred burial grounds has continued unabated since the ruling.

KMA Circuit Court Affirms Huahi Achama Tutuwaa Royal Family's Allodial Ownership of Benimasi-Boadi Lands

His Lordship Abdul Razak Musah, sitting as Additional Circuit Judge at Kumasi (Suit No. KI/29/2023), delivered judgement affirming the Huahi Achama Tutuwaa Royal Family as the allodial owner of the Benimasi-Boadi lands. The Court declared all purported sales of the land null and void and granted a permanent injunction and recovery of possession. This judgement is relied upon as Exhibit G in the current High Court proceedings.

Lands Commission Issues Search Report Confirming Family's Unencumbered Title — KNUST Lease Not Registered Against Boadi Lands

The Lands Commission, Kumasi issued Search Report Certificate No. KSI. 239/2021 on 29 January 2021, confirming that the Huahi Achama Tutuwaa Royal Family's legitimate rights to the Benimasi-Boadi lands are unencumbered by KNUST's purported lease. The certificate constitutes official government confirmation that KNUST's occupation of the Boadi lands has no valid legal basis.
